Definition of online sales contract

An online sales contract is a contract for the purchase of goods and products remotely between a customer and the seller, concluded using only the internet technologies made available by the seller on its website www.lapietrella.it.

Commercial relations between Zsg Company Sas Di Errico Suann , owner of the website www.lapietrella.it, and its customers are governed by the following general conditions of sale. These conditions may be modified by the seller, but any changes will be effective only when published on the aforementioned website and will apply to sales made from that moment on.

Payments

Payment can be made by credit card, PayPal, or bank transfer.

Payments can be made with Visa, Visa Electron, Mastercard, and American Express credit cards, or via PayPal or bank transfer. Transactions are highly secure, as data is transmitted encrypted using SSL. For Visa and Mastercard payments, only CES (Secure Electronic Commerce) transactions are accepted. After verifying that the credit card is accepted by the CES system, the system contacts the issuing bank to allow the buyer to complete the purchase. Once the bank confirms the card's authenticity, the charge is made. Otherwise, it is cancelled.

For payments made by bank transfer, orders will be processed only after verification of payment.

Conclusion of the contract

Acceptance of the sales proposal presented by Zsg Company Sas Di Errico Suann is confirmed by accurately completing the order form and expressing consent to the purchase by completing the online form. The customer who places the order will receive an email confirming receipt of the order at the end of the process. This confirmation constitutes the finalization of the contract, but its effectiveness is subject to payment for the goods, which must be made within 5 days of the contract being finalized.

Otherwise, the order will be automatically cancelled and the available goods will be released.

Shipping times

Shipments are made via express courier. Couriers do not deliver on Saturdays, Sundays, or national holidays.

From the day the bank notifies you of payment, your order will be processed and delivered within a minimum of 48 hours and a maximum of 10 working days. Delivery cannot, in any case, exceed 30 days from the order date (pursuant to Article 6 of Legislative Decree 185/1999). Deliveries will be made throughout Italy via national couriers and freight forwarders trusted by the recipient. In any case, the supplier cannot be held liable for delayed or failed deliveries due to force majeure or unforeseeable circumstances.

Selling prices

All prices listed on the online store www.lapietrella.it represent an offer to the public pursuant to art. 1336 of the Italian Civil Code and include VAT at the rates applicable to the relevant products under current Italian law. The price of the products included in the customer's order will always include shipping costs, except for any promotions, which will be clearly identifiable.

In the shopping summary, and in any case before final confirmation of the order, the customer will be able to view the unit costs of the products, shipping costs, and totals. Payment can be made using one of the methods provided and described in the relevant section to which reference is made.

Buyer's obligations

Once the online purchase process has been completed, the customer undertakes to print and retain these general terms and conditions of sale, which they will have already reviewed and accepted as a mandatory step in the purchase process, as well as the specifications of the purchased product, in order to satisfy the conditions set forth in Articles 3 and 4 of Legislative Decree 185/1999. The buyer is prohibited from entering false information, in whole or in part, during the registration process required to initiate the contract execution process and any related communications. The personal details and email address must therefore be the buyer's actual personal information and not those of third parties and/or fictitious.

Seller's right of withdrawal

Zsg Company Sas Di Errico Suann has the right to withdraw from the contract within 7 days of its conclusion by simply notifying the customer via email, without the need to provide a specific reason. In this case, the customer will only be entitled to a refund of any sums already paid.

Jurisdiction and competent court

This contract, drawn up in Italian, is subject to Italian jurisdiction. These general conditions, unless expressly provided otherwise, are governed by the provisions of the Italian Civil Code, Legislative Decree 185/1999, and Legislative Decree 70/2003. Any dispute relating to the application, execution, interpretation, or violation of the online sales contract shall be subject to the exclusive jurisdiction of the Court of Naples.

Order cancellation

Order cancellations can only be made by sending an email to aeurocorredo2009@libero.it without specifying a reason, and if the order has not already been shipped. Customers can monitor their order status through their control panel. Once the order status is "Shipped," it can no longer be cancelled.

Right of Withdrawal

Pursuant to Legislative Decree No. 190 of August 19, 2005, implementing Directive 2002/65/EC on consumer protection in respect of distance contracts, the consumer has the right to withdraw from the purchase, without penalty and without specifying the reason, within 14 days of receiving the purchased goods. In the communication, it is necessary to indicate the order confirmation number, a precise description of the products you wish to return, even partially, the bank details of the current account to which the amount of the returned products will be refunded, or, alternatively, the name and precise address of the beneficiary of the postal order credit.

To facilitate the fulfillment of your request, we recommend that you communicate your intention to exercise your right of withdrawal by email (info@lapietrella.it).

In the event of a cancellation, the purchased and delivered goods must be returned by the customer within 12 working days of receiving the purchased goods, at their own expense, in their complete integrity and in their original packaging.

The packages of the products to be returned must be perfectly intact and sealed in their original packaging.

After verifying the aforementioned conditions of the returned products, we will refund the dissatisfied customer the amount already collected, relating to the goods for which the right of withdrawal was exercised, within 30 days of receiving the registered letter with return receipt, and in any case not before the goods have been returned.

Billing

Online sales are treated as mail order. A receipt or invoice is not required for sales to private individuals, as the seller is responsible for maintaining proper records of payments. VAT-registered customers may request an invoice by providing their details via email. All prices listed in our online store include VAT at the rates applicable to the respective products under applicable Italian law.
